A statement given by senior congress leader and Punjab local bodies minister Brahm Mohindra on Mayor Patiala suspension issue, has brought an embarrassment for Punjab government.
After, around 25 days, Mayor Sanjeev Sharma Bittu got relief from Punjab and Haryana High Court, as his suspension orders, verbally given by local bodies minister Brahm Mohindra, has been suspended.
Everyone in the political, administrative circles is talking about the need of the statement given by local bodies minister Brahm Mohindra when he had no clarity of the act.
“Brahm Mohindra is regarded as a seasoned politician and this type of immaturity was never expected from him” said a retired Punjab government officer, when asked Was statement given in hurry by minister bring embarrassment to Punjab government?
Today, Ajoy Kumar Sinha, IAS, principal secretary to government of Punjab, department of Local Government has issued a “Speaking Orders” . He observed that” after careful consideration of the factual position of the case as well as legal advice tendered by Learned Advocate General,Punjab, the undersigned has come to conclusion that the execution of the present resolution would be in contravention of and in excess of the powers conferred by this Act , so, the present Resolution No. 391 dated 25-11-2021 is hereby suspended under section 422 of the Punjab Municipal Corporation Act, 1976. The house of the Municipal Patiala is further directed to takeup the supplementary agenda regarding No Confidence Motion, if again pressed in writing by the councilors who made the requisition under section 39 of the Punjab Municipal Corporation Act, 1976.” Therefore, the resolution no. 391 dated 25-11-2021 and the Representation dated 26-11-2021 (P-7) given by Sanjeev Sharma (Bittu) , Mayor, Municipal Corporation are decided in above terms.
On November 25,2021, after the general house meeting of the Patiala Municipal corporation, local bodies minister Brahm Mohindra came out and announced the suspension of the Mayor Sanjeev Sharma Bittu, for not able to show the required number of municipal councilors on his side, during the no confidence motion against him. Brahm Mohindra announced the senior deputy mayor Yoginder Singh Yogi as the acting mayor of Patiala.
Whereas the Mayor Sanjeev Sharma Bittu said “he has more than the required number of one third Councillors with him’. The proceedings of the general house, which was convened by its chairman, Mayor Sanjeev Sharma Bittu, were signed by acting mayor Yoginder Singh Yogi and forwarded to the director local bodies, as per the set procedure. Bittu challenged it, it in the Punjab and Haryana High court and today he got the relief. His suspension orders were suspended by the local bodies department.
